Consumer Law
The 1988 Constitution guarantees, in article 5, subsection XXXII, consumer protection. The consumer protection code was published on September 11, 1990, consisting of article 118, which would enter into force 180 days after its publication. This standard has actually created a change in behavior in the market, whether on the part of consumers or suppliers.
I'll also put the concept of consumer right below.
Consumer Concept, I'm going to put this concept below, which is of paramount importance for everyone today.
Article 2 of the code defines the consumer.
Article 2 Consumer is any individual or legal entity that purchases or uses a product or service as the final recipient.
Sole Paragraph equates a consumer to a collective of people, even if endless, who have intervened in consumer relations.
The Consumer Concept is divided into four concepts:
1-The standard concept according to the consumer is the natural or legal person who purchases the product or uses the service as the final recipient.
2-The collectivity of people, even if undeterminable, who have intervened in consumer relations in order to enable the filing of the class action provided for in article 81, sole paragraph.
3- Victims of consumer accidents (art 17), so that they can use the mechanisms and instruments of the CDC to defend their rights.
4-Those who are exposed to commercial practices (advertising, offers, general clauses of contracts, abusive commercial practices).
The concepts I mentioned here, one can see the breadth and detail given by the legislator to consumer relations.
